Abstract

Economic crises and the precariousness of Labor Law have generated harmful flexibilities for the worker. Outsourcing and the dismantling advocated by the Labor Reform have been pointed out as instruments to recover the economy. However, the growth of work analogous to slavery is a growing reality and the outsourcing of employment relationships has opened space for such a violation. This article analyzes such institutes with a critical bias based on the Marxist theories advocated by Jean-Paul de Gaudemar and the mobilization of the workforce for capital, since all material possibilities of a dignified social existence are removed from the worker, except that of sale of his workforce, sometimes exposing him to vulnerable and inhumane situations. Sociological and Legal theories are approached, in the legal context with the presentation of empirical cases in an attempt that effective measures are taken to combat the precariousness of work and the exploitation of workers, with the due punishment of offenders, reanalysis of the outsourcing institute after the labor reform, as well as the creation of policies that enable the transparency of information that contribute to sustainable development and a new education
