Consequencialismo no processo decisório em tempos de crise sanitária – teoria dos jogos e as ações regulatórias no combate à Covid-19

The present work aims to analyze the consequentialism in the decision-making process of public administration in Brazil. With the changes caused in the old Law of Introduction to the Civil Code, now known as LINDB – Law of Introduction to The Rules of Brazilian Law, the technical basis in the decision-making process ceased to be a formal requirement focused on the judicial function but also became a requirement of validity for the activities of public management. In this process of foundation, game theory can be a tool of high relevance for the aid and foundation in decision making, especially when the manager is faced with scenarios of high complexity such as the action in the fight against a pandemic such as the present COVID-19. Generic foundations, mere statements of "pursuit of collective well-being" or "social interest" are no longer accepted, and it is necessary to demonstrate the consequences of decisions and how to implement public actions.
